أبواب مخيم ليبرتي يجب أن تفتح أمام المحامين والصحفيين ليمكن لهم اللقاء والحوار مع السكان
• كل من أكد وجود المقاييس الإنسانية وحقوق الإنسان والمعايير الدولية لحماية اللاجئين خاصة حرية التنقل في «عملية نقل طوعية»، ينبغي أن يظهر أمام الصحفيين والسكان ليجيب على الأسئلة
بعد ظهر اليوم الجمعة 17 شباط (فبراير) 2012 وبطلب السيدة مريم رجوي رئيسة الجمهورية المنتخبة من قبل المقاومة الإيرانية لمرحلة نقل السلطة إلى الشعب الإيراني، يتوجه 400 من أعضاء منظمة مجاهدي خلق الإيرانية في مخيم أشرف إلى مخيم ليبرتي. ولكن خلافًا للدعايات والتصريحات الإعلامية لم يتم توفير الحدود الدنيا للضمانات ولم يؤكد أحد وجود المقاييس الإنسانية ومعايير حقوق الإنسان في هذا المخيم. فهناك محاولة من خلال التصريحات الإعلامية المضللة والمراوغة للإيحاء بأن البنى التحتية الفنية مثل عدد حنفيات الماء (الخالية من الماء الصالح للشرب) والتي أعلنها تقني خبير في بناء المآوي تساوي توفير المعايير الإنسانية.
فقد أكدت المفوضية العليا للأمم المتحدة في شؤون اللاجئين ضرورة حرية التنقل وتمتع السكان بإجراءات حماية أساسية وتوفير الأمن والرفاهية لهم باعتبارهم طالبي اللجوء و«أشخاصًا مثار القلق».
إن توجيه الدعوة إلى الصحفيين يجب أن لا يهدف إلى الاستغلال السياسي والإعلامي فقط وأن لا يكون مثلما كان عليه في الماضي من دون تمكينهم من الوصول إلى السكان واللقاء والحوار معهم.
وينبغي لكل من أكد وجود المقاييس الإنسانية وحقوق الإنسان والمعايير الدولية لحماية اللاجئين خاصة حرية التنقل في «عملية نقل طوعية»، أن يظهر أمام الصحفيين والسكان ليجيب على الأسئلة. ليس هناك موقع إلا سجنًا يسمى بـ «ليبرتي» ما لم يتم توفير حرية التنقل وتأمين الوصول الحر إلى الخدمات الطبية واللقاء بالمحامين وخروج العناصر المسلحة العراقية من الحرم الداخلي للمخيم.

بغداد- العراق- انتقد نحو 400 من أعضاء جماعة إيرانية معارضة في المنفى ينوون ترك معسكر أشرف في العراق في إطار خطة للأمم المتحدة، المعاملة التي يلقونها والظروف في الموقع المؤقت الجديد الذي يؤويهم.
وقال شاهين جبادي من المجلس الوطني للمقاومة الإيرانية في بيان إن المجموعة غادرت مخيم أشرف في منتصف الليل بعد نحو 12 ساعة من عمليات التفتيش والتدقيق.
وأضاف البيان أنهم 'عندما وصلوا بعد نحو سبع ساعات إلى الموقع الجديد، وهو قاعدة عسكرية أمريكية قرب مطار بغداد الدولي كانت تسمى معسكر ليبرتي، اكتشفت المجموعة وجودا كثيفا للشرطة.'
وتابع قائلا 'تم إجراء تفتيش آخر بعد ذلك، ما دفع السكان للاحتجاج على ما يعتبرونه المعاملة المهينة، والمذلة وغير الإنسانية،' مضيفا 'أن التقارير الأولية تشير إلى أن معسكر ليبرتي هو سجن من جميع الجوانب.'
وتم الاتفاق على نقل السكان إلى موقع جديد بين الأمم المتحدة والسلطات العراقية والولايات المتحدة والاتحاد الأوروبي.
وكان معسكر أشرف منزل لأعضاء حركة مجاهدي خلق، لأكثر من 25 عاما، إذ يعيش نحو 3000 شخص، معظمهم شخصيات في المقاومة الإيرانية ومتعاطفين معهم.
منذ عام 2004، نظرت الولايات المتحدة للسكان من 'غير المقاتلين' في معسكر أشرف على أنهم 'أشخاص محميين' بموجب اتفاقيات جنيف.

تفاصيل وقائع نقل 397 من سكان أشرف إلى مخيم ليبرتي ومضايقات مفروضة عليهم


فجر يوم السبت توجه 397 من سكان أشرف إلى مخيم ليبرتي وذلك بطلب من رئيسة الجمهورية المنتخبة من قبل المقاومة وعقب دعوات كل من الأمين العام للأمم المتحدة ووزيرة الخارجية والممثلة العليا للاتحاد الأوربي. فحركة القافلة تمت بعد تأخير دام 12 ساعة واجراء تفتيش ينم عن حقد دفين والمحاولة لسرقة الأموال من قبل بعض العناصر العراقية حيث واجه اعتراضات وشعارات ضاربة من قبل المجاهدين الأشرفيين.
قافلة المجاهدين انطلقت في الساعة الثانية بعد منتصف الليل من البوابة الرئيسية لأشرف نحو مخيم ليبرتي.
 12 ساعة من أعمال التفتيش بكلاب بوليسية ووضع عراقيل متعمدة وتعامل لاإنساني ومنع غير قانوني من نقل أكثر الحاجات ضرورية حيث منعت العناصر العراقية وبطلب من الولي الفقيه للنظام الرجعي نقل الطاولات والكراسي وأدوات تستعمل مثل سكاكين المطبخ أو صوبات نفطية ووسائل اتصالات ومدفئة زيتية وجهاز استنساخ وكاميرات للتصوير وكرسي دوار للمرضى.
اثنان من مجاهدي خلق وبسبب أخذ كاميراتهم للتصوير وكرسي دوار لهما رفضا الذهاب إلى ليبرتي. ولاقت قافلة المجاهدين الاشرفيين في الساعة 6.30 من صباح يوم السبت وبعد 48 ساعة من الأرق ومواجهة شتى محاولات لوضع العراقيل في مدخل ليبرتي، موجة أخرى من سوء المعاملة والاصرار علي تفتيش غير قانوني وتعامل لاإنساني من قبل العناصر العراقية.
وكان الجلاد المجرم صادق محمد كاظم الذي يلاحقه القضاء الاسباني لارتكابه جرائم قتل بحق المجاهدين الاشرفيين في 28 و 29 تموز 2009 و 8 نيسان 2011 قد حضر الموقع ليقوم من جديد بتفتيش المجاهدين. الا أنه لا أحد قد نزل من الحافلات حيث طلب المجاهدون فورا العودة الي أشرف وأعلنوا بحزم انهم لا يقبلون اطلاقا مهما كان الثمن ما يفرضه عناصر قوه القدس الإرهابية ونظام ولاية الفقيه في العراق. انهم أكدوا أنهم لن يستسلموا اطلاقا ومهما كان الثمن أمام تحويل ليبرتي إلى سجن. 
ولاحقاً تدخل مراقبو الأمم المتحدة وفريق مارتن كوبلر الذي اعتمد الصمت والتقاعس والضغط على مجاهدي ازاء التعاملات اللاإنسانية وخرق صارخ للقانون الدولي، ليقنعوا المجاهدين على الرضوخ لأوامر الجلاد صادق محمد كاظم الا أن محاولاتهم لم يكتب لها النجاح. ثم بدأت اتصالات مكثفة بين مسؤولي الأمم المتحدة والمسؤولين الأمريكيين للالتماس من رئيسة الجمهورية المنتخبة من قبل المقاومة في باريس للتوسط في الأمر. وعقب اعتراض ممثل سكان أشرف خارج العراق في اتصاله مع مارتن كوبلر الممثل الخاص للأمين العام للأمم المتحدة، أوقفت العناصر العراقية محاولاتهم لفرض أعمالهم الغير قانونية لتفتيش المجاهدين الاشرفيين من جديد واكتفوا بتفتيش متعلقات السكان بالكلاب البوليسة فقط.
وأدرك المسؤولون الأمريكيون في بغداد وواشنطن وكذلك مسؤولو الأمم المتحدة بوضوح أن الجلاد صادق محمد كاظم لم يظهر في الميدان الا لاختلاق حادث واطلاق  الرصاص والمواجهة ويجب سحبه من الميدان. 
وكان هذا السفاح ومثلما فعل قبل عامين خلال عملية حجز 36 من الاشرفيين كرهائن في محاولة لتسقيط الأفراد وجعلهم نادمين، قام بلصق ورقة خلف كل كرفانة كتب عليها كل من ينفصل عن مجاهدي خلق فانه سيرسله فورا إلى الخارج ويوفر له امكانيات كافية. الا أن المجاهدين الاشرفيين قد نزعوا الاوراق ورموها تحت أقدامهم ودهسوها مثل صور الولي الفقيه للنظام الرجعي ورموها في المزابل.
وحينما راحت الأزمة تتفاقم وعندما بدأ الوضع ينفلت من السيطرة وكان المجاهدون مصرين على العودة إلى أشرف، اتصل الممثل الخاص للأمين العام من ليبرتي بالسيدة مريم رجوي في باريس مطالبا رئيسة الجمهورية المنتخبة من قبل المقاومة بالتدخل مرة أخرى لمعالجه المشاكل. وقدم الممثل الخاص تقريراً عن الموقف في ليبرتي مؤكدا على تعهد مراقبي الأمم المتحدة لمعالجه المشاكل الحاصلة وأكد قائلا: بعد اتصالات الأمم المتحدة والمسؤولين الأمريكيين مع المسؤولين العراقيين تقرر على تهدئة الوضع والتجنب من أعمال استفزازية.
وأكدت رئيسة الجمهورية المنتخبة من قبل المقاومة حساسية الموقف تجاه التعامل اللاإنساني مع سكان أشرف طيلة الساعات الـ48 الماضية وخاصة التعامل الغير قانوني في ليبرتي وتدخل قاتل معروف، محذرة من تعامل العناصر العراقية خاصة حضور الرجال المسلحين في الحرم الداخلي للمخيم. وأعادت السيدة رجوي إلى الأذهان بيانها الصادر في 16 شباط وطلبها من سكان أشرف للموافقة على انتقال 400 منهم إلى ليبرتي وأكدت قائلة: ان المجموعات التالية ستنتقل بعد توفير الحد الأدنى من التطمينات خاصة انسحاب الشرطة من الحرم الداخلي لليبرتي ويأتي هذا للتجنب من اندلاع أي توتر وعنف واراقة الدماء من جديد.
وبحسب التقارير فان أحد المسؤولين العراقيين وعقب تظاهرة واعتراض قوي للمجاهدين الاشرفيين في ليبرتي حضر الموقع وأعلن ان صادق محمد كاظم لن يكون له دور هناك وأن العناصر المسلحة ينسحبون من داخل الحرم الي بوابة الدخول.
وكان السفاح  المذكور قد أصدر أمره في وقت سابق وعلى غرار أعمال السُخرية والتعامل مع أسرى الحرب أن يقفوا على نحو منتظم للتعداد الا أن المجاهدين لم يعتنوا به لكي لا يقوم بمثل هذه العنتريات مرة أخرى وقيل ان هنا لا أحد يقبل التعداد بطريقة السجن  والافراد المسلحين يجب أن ينسحبوا فورا من داخل الحرم إلى مدخل المخيم. والا يجب أن يتم اعادة المجاهدين إلى أشرف. وأعلن المجاهدون انه مادامت العناصر العراقية المسلحة تطوق قاعة الطعام الوحيدة في المخيم فانهم يمتنعون عن الذهاب إلى القاعة. وفي عمل سخيف آخر أمر السفاح صادق محمد كاظم أن يسكن المجاهدون في الكرفانات التي عينها هو الا أن المجاهدين لم يعتنوا به أيضا وسخروا من سجان السجن الجديد لولاية الفقيه وأفشلوا خطته. الواقع أن نظام ولاية الفقيه وعشية السقوط بحاجة شديدة إلى أعمال القمع وفرض المزيد من القيود على مجاهدي خلق..
من جانب آخر طلع السيد مارتن كوبلر والمستشار الأمني للمالكي على الشاشة للتغطية على فضيحة ليبرتي ولاستهلاك دعاية إعلامية.
وقالت رويترز بعد العلاقات الوثيقة للحكومة العراقية مع النظام الإيراني لم تعد منظمة مجاهدي خلق موضع ترحيب في العراق. وتم اجلاء الدفعة الأولى لسكان أشرف  إلى «موقع عبور» بقاعدة عسكرية أمريكية ضخمة في بغداد.
وقال فالح الفياض العامري مستشار أمني عراقي: ان عملية العراق الجديد لنقل السكان من المخيم وبانتقال أول مجموعة منهم بدأت الليلة الماضية وصباح اليوم. العراق يعاني من مشكلة خلفها النظام السابق وأثرت على علاقات العراق مع جيرانه والمقصود النظام الإيراني واننا لا نقبل أن تنتهك سيادة العراق من خلال ذلك. وقررت الحكومة العراقية العام الماضي أن تنهي وجودهم وتغلق المخيم.
وأضافت رويترز: يقول المجلس الوطني للمقاومة الإيرانية ان الاتفاق على نقل الدفعة الأولى هو بادرة حسن نية لكن شكاواها من المخيم وكيفية اجراء عملية النقل تشير إلى انه لا تزال ثمة صعوبات مستقبلية. ويشبّه المجلس الوطني للمقاومة الإيرانية الموقع الجديد بالسجن. ويقول إن الناس لن تتمكن من القدوم والذهاب بحرية او سيتمكنون من الوصول دون قيود إلى المحامين او الخدمات الطبية. وشكا أيضا من القيود على المتعلقات التي يمكن لسكان المخيم ان يأخذوها معهم.
ويقول مارتن كوبلر الممثل الخاص للأمم المتحدة إن الموقع يطابق المعايير الإنسانية لحالات اللجوء ويجري هناك رصد على مدار 24 ساعة وأيام الأسبوع السبعة. وقال احد أعضاء المجلس الوطني للمقاومة الإيرانية ان عملية البحث المفصلة عن متعلقات كل شخص استغرقت وقتا طويلا جدا لدرجة انهم وصلوا بعد نحو 24 ساعة من وصول وسائل الإعلام التي دعيت إلى مخيم الحرية لتشهد عملية النقل. ورغم أن منظمة مجاهدي خلق الإيرانية قد وضعت في لائحة الإرهاب الأمريكية رسميا الا أن مخيم أشرف وبعد الغزو الأمريكي للعراق قبل 9 سنوات كان محمياً من قبل القوات الأمريكية. وسلمت واشنطن المخيم إلى العراق في عام 2009.

انتقال 400 من سكان أشرف إلى مخيم ليبرتي في بغداد















بغداد- انتقلت مجموعة من المعارضين الإيرانيين بالعراق من سكان معسكر أشرف إلى معسكرهم الجديد قرب العاصمة بغداد صباح اليوم السبت، لكن منظمة مجاهدي خلق الإيرانية المعارضة التي كانت وافقت على نقل عناصرها إليه اعتبرته سجنا جديدا.
وبطلب من مريم رجوي والأمين العام للأمم المتحدة ووزيرة الخارجية الأمريكية والممثلة العليا للاتحاد الأوربي توجه الليلة الماضية 400 من سكان أشرف كوجبة أولى تجريبية إلى مخيم ليبرتي.  
وأوضح المستشار القانوني لمجاهدي خلق بهزاد صفاري في تصريح تلقته وكالة الصحافة المستقلة (إيبا).. أن المجموعة التي انتقلت إلى المعسكر الجديد ليبرتي تضم 397 معارضا، وقال باتصال هاتفي مع وكالة فرانس برس الساعة السادسة من صباح اليوم بتوقيت بغداد نحن عند مدخل معسكر ليبرتي، والحافلات تخضع للتفتيش.
 وأضاف صفاري المقيم بمعسكر أشرف منذ عام 2003 لقد فتشوا كل الأمتعة ومنعت القوات العراقية نقل بعض الأغراض مثل الكاميرات وسكاكين المطبخ.
 وفي صباح يوم الجمعة وقبل توجههم إلى ليبرتي زار سكان أشرف مقبرة «مرفاريد» للشهداء في مخيم أشرف وأدوا فيها صلاة التحية ترحمًا على أرواح الشهداء. وكانت بعض شواهد قبور الشهداء قد كسرت من قِبل عملاء مخابرات النظام الإيراني من قـَبل.  
وتندرج هذه العملية في إطار الاتفاق الذي تم التوصل إليه بين الأمم المتحدة والعراق في 25 ديسمبر/ كانون الأول الماضي بعد مفاوضات مكثفة. وينص الاتفاق على نقل 3400 معارض للنظام الإيراني لمعسكر ليبرتي في إطار عملية من المفترض أن تنتهي بمغادرتهم البلاد.
 وقبل ظهر يوم الجمعة حضر الممثل الأقدم للسفارة الأمريكية الموقع وأكد حسب بيان وزارة الخارجية الصادر يوم الخميس أن المراقبين الأمريكيين سيزورون ليبرتي 5 أيام من كل اسبوع للتأكد من أمن وسلامة السكان. كما أكد الممثل الأقدم للسفارة الأمريكية أن السيدة هيلاري كلينتون وزيرة الخارجية الأمريكية تتابع موضوع أشرف.
 وأضاف أن عليه أن يرفع تقريراً عن التطورات والنقل إلى وزيرة الخارجية الأمريكية فور عودته من أشرف.  
من جانبها ممثلة المفوضية العليا لشؤون اللاجئين أكدت أن وحدة دورية خاصة للمفوضية السامية للاجئين ستكون في متناول اليد في ليبرتي. 
ومنذ الساعات الأولى من صباح يوم الجمعة وصل إلى أشرف عدد من المراقبين وقوات ذات القبعات الزرق التابعة للأمم المتحدة لمواكبة ومراقبة عملية النقل.
 وكان الطريق من أشرف إلى ليبرتي مرصود وخاضع لسيطرة وحماية مشددة من قبل مختلف القوات العراقية حيث كانت المروحيات تحلق على المسير. وكان مراقبو الأممالمتحدة يراقبون انتقال سكان أشرف.
 وبهذا الصدد ومن أجل معالجة المشاكل والتأكد من استعداد 400 من سكان أشرف للانتقال، اتصل مارتين كوبلر الممثل الخاص للأمين العام للأمم المتحدة ظهر يوم الجمعة بباريس وتحدث مع السيد محمد سيد المحدثين ممثل سكان أشرف خارج العراق.
 وأعرب الممثل الخاص للأمين العام في نهاية الاتصال عن شكره.
 وكان بيان للأمين العام للأمم المتحدة وبيان وزارة الخارجية الأمريكية بهذا الصدد قد صدرا مساء الخميس. وجاء التأكيد في بيان فيكتوريا نولاند الناطقة باسم الخارجية الأمريكية حول مخيم أشرف: الولايات المتحدة الأمريكية مازالت تبحث عن حل سلمي وإنساني لحالة غير قابلة للتحمل في مخيم أشرف. الخطوة المهمة هي الانتقال الطوعي لاول مجموعة مكونة من سكان أشرف مشكلة من400 فرد إلى منشأة مؤقتة جديدة في (مخيم الحرية).
 وتدعم الولايات المتحدة دعوة الامم المتحدة للحكومة العراقية وسكان مخيم أشرف إلى الاستمرار في التعاون والبدء في عملية الانتقال هذه بصورة سلمية ودون تأجيل. الولايات المتحدة لا تترك سكان مخيم الحرية واننا نزورهم بانتظام وبشكل متكرر وسنواصل العمل مع الأمم المتحدة لدعم الانتقال المؤقت وبالتالي توطين آمن وسالم لسكان أشرف خارج العراق مع احترام سيادة العراق وكذلك بناء على مسؤوليات الحكومة العراقية للتعامل الإنساني.
 وانتقدت مجاهدي خلق في بيان لها أمس وضع المخيم الجديد وتجهيزاته، قائلة ليس هناك غير سجن يسمى ليبرتي ما لم يتم توفير حرية التنقل وتأمين الوصول الحر إلى الخدمات الطبية واللقاء بالمحامين وخروج العناصر المسلحة العراقية من الحرم الداخلي للمخيم.

"تقصى الحقائق" بـ"المحامين": توصلنا لمعلومات موثقة عن مرتكبى مجزرة بورسعيد

قال طارق إبراهيم وأشرف طلبة، عضوا لجنة الحريات بنقابة المحامين، إن "الحريات" شكلت لجنة تقصى حقائق فى أحداث مجزرة بورسعيد التى راح ضحيتها عشرات القتلى ومئات المصابين عقب مباراة الأهلى والمصرى الأسبوع الماضى.
وأضاف أشرف طلبة لـ"اليوم السابع"، أن لجنة تقصى الحقائق وصلت بورسعيد منذ يوم الأحد الماضى، وتوصلت إلى معلومات خطيرة موثقة بالصوت والصورة والمستندات عن الحادث والمتسببين فيه، وكشفت أن هناك شخصيات جديدة ومهمة مدانة فى الحادث.
وأوضح عضو المكتب التنفيذى للجنة الحريات بنقابة المحامين أن لجنة تقصى الحقائق ستعد تقريرا مفصلا عما توصلت إليه من معلومات حول مجزرة بورسعيد وستقدمه للمستشار عبد المجيد محمود النائب العام السبت المقبل.
توجه إلى بورسعيد من أعضاء لجنة الحريات كل من طارق إبراهيم، أشرف طلبة، ناصر العسقلانى، رشا الحسينى، بالإضافة إلى صلاح صالح عضو مجلس النقابة العامة، وتحت إشراف محمد الدماطى وكيل النقابة، وخالد أبو كريشة عضو المجلس.

3 February 2011 was the day when protests in Yemen transformed into a mass movement. On that day a broad group of mainly students and activists calling itself the Youth of 3 February (since referred to itself as Youth of the Revolution) attracted tens of thousands of people to mass protests in the capital Sana’a.
Protests had begun the previous month after the government announced draft constitutional amendments to allow President Ali Abdullah Saleh, head of state since 1978 – first as President of north Yemen and then of unified Yemen –  to run for Presidential elections for unlimited terms. But they were also fuelled by frustration at corruption, unemployment and repression of freedoms in the country, and partly inspired by events in Tunisia and Egypt.
The protesters called on President Ali Abdullah Saleh to dismiss the government and corrupt officials, dismiss his son as head of the Republican Guard and Special Forces, dissolve Parliament, appoint a government of national unity, return “embezzled” funds, and resign from the presidency and pledge not to run for office again.
Q: A year since protests began, how has the human rights situation changed?

2011 saw a rapid deterioration in the human rights situation in Yemen. The most shocking manifestation of this has been the brutal repression of protests. More than 200 protesters have been killed and more than 1,000 injured after security forces have repeatedly used live ammunition to break up demonstrations. Hundreds more have been killed on all sides in armed clashes.
The track record of the authorities in investigating allegations of serious human rights violations by the security forces has been very poor. Amnesty International is aware of only one judicial investigation – into the killings of protesters on 18 March 2011. According to the Office of the UN High Commissioner for Human Rights, an official investigation resulted in 78 people being charged, but it is unclear whether these included members of the security forces. The authorities have offered compensation to some of the victims’ families.
Armed clashes
have continued to take place across the country, leaving a growing humanitarian crisis in Yemen with water, electricity and other supplies diminishing.
Q: What is the situation now for Yemen following the signing of the Gulf Cooperation Council-brokered political deal?

Following the events of March 2011, when in the worst single incident at least 52 people were killed during a protest, the Gulf Cooperation Council (GCC) offered President Saleh a deal which would guarantee him immunity from prosecution in return for his leaving office. In October the UN Security Council urged President Saleh to hand over power in accordance with the GCC agreement.
After a UN envoy helped the parties negotiate, President Saleh signed the deal in November, agreeing to hand some powers over to the Vice President, to the appointment of a new Prime Minister heading a “government of national reconciliation” and to the holding of presidential elections within 90 days. In return, President Saleh and his aides were to be given immunity.
A Prime Minister from the opposition has now been appointed and a new national government – to remain in power for an interim period of two years – is in place, representing the ruling party and members of the opposition. Ali Abdullah Saleh retains the title of President until the elections, which are expected to take place in February.
An immunity law was passed on 21 January 2012 providing President Saleh with complete immunity from prosecution and all those who worked during his rule are also provided immunity from criminal prosecution in ‘politically motivated cases’. Protests have continued, denouncing the immunity law.
Amnesty International is calling on the GCC and the international community to withdraw its support for immunity for any official in Yemen, regardless of rank or affiliation. The immunity law breaches Yemen’s obligations under international law.
The fact that the UN gave support to the transition power-transfer deal when it was signed on 23 November when it was believed to have contained an immunity provision is regrettable. The UN Secretary General has previously issued a directive prohibiting brokering peace agreements which contain immunity clauses.
Q: Why does Amnesty International oppose immunity for Yemeni leaders? Some people have argued that they will provide stability.

The passing of the immunity law has dealt a serious blow for those calling for justice for human rights violations. Amnesty International has documented serious violations in Yemen carried out by or with the complicity of state agents. It is unacceptable that victims of such crimes should be prevented from getting justice.
Impunity for perpetrators will prevent the protection and promotion of human rights for all those in Yemen, at just the moment at which there is an opportunity for change.
We do not agree that immunity will deliver stability
for the people of Yemen. To prevent violations of human rights and humanitarian law being committed in the future, there must be accountability for past abuses. In contrast this, the law sends signals to future leaders of Yemen that if they commit enough abuses they may be given immunity simply to see them leave office.
The Yemeni government has said it wants to put in place ‘transitional justice’ mechanisms to provide justice and reparation to victims of abuses and to prevent further violations of international human rights and humanitarian law. It is unclear how this could be compatible with an immunity law which provides complete impunity to President Saleh and could apply immunity to all those who were his subordinates. It is not clear after all what is meant by ‘politically motivated cases’.
Q: What about human rights abuses being committed by non-governmental armed groups within Yemen?
Amnesty International condemns human rights abuses however, wherever and by whomever they are committed.
Over the years non-governmental armed groups are reported to have carried out kidnappings, attacks including on civilian population. In 2011 there were two reports – which Amnesty International has not been able to confirm – of amputations by armed Islamist militants claiming to apply Shar’ia law.
It is the Yemeni authorities’ responsibility to protect people in Yemen from violence by armed groups and to ensure that the human rights of everyone in Yemen are respected and protected at all times.
Any solution to the security challenges in Yemen must have at its heart the protection of human rights. All measures taken against armed groups must be carried out in accordance with international standards which prohibit, among other things, extrajudicial killing, enforced disappearance, torture and arbitrary detention.
Q: Yemen faces many challenges, including multiple armed clashes and loss of control over parts of its country. In this context can the Yemeni government be expected to meet such challenges by strictly adhering to international human rights standards?

Yemen does face serious challenges but, like all states, the government must deal with such challenges - whether political, security or economic - in accordance with its obligations under international human rights law.
The government bears the primary responsibility for making human rights a reality. Governments must respect peoples' rights and ensure that other people do not abuse these rights. Lack of resources or conflicts is no excuse for violating or neglecting human rights.
Unfortunately, many measures have been taken in recent years in Yemen, in the name of stability and security, without due adherence to international human rights obligations and standards.
The authorities must adequately investigate reports of massive violations committed in the past: in the context of the unrest in the south of Yemen against those seen as secessionists; in the name of countering terrorism against those accused of belonging to or supporting al-Qa’ida; and in the context of the intermittent conflict in the north between government forces and the Huthi rebel movement against suspected Huthi supporters and, more widely, the civilian population of the region.
Q: What has the Nobel Peace Prize for Tawakkol Karman meant for Yemen?

Human rights activist Tawakkol Karman has been a leading figure since mass protests against the government began in February 2011. In January 2011 she was arrested by the authorities
and charged with organizing an unlicensed protest, sparking outrage among other protesters.The awarding of the Nobel Peace Prize to Tawakkol along with two other women, recognized the work of activists to defend the rights of women around the world for “their non-violent struggle for the safety of women and for women's rights to full participation in peace-building work".
Awarding such a global prize to a Yemeni woman for her outstanding work gives hope to the millions of Yemeni girls and women living under discriminatory laws placing them at a lower status than that of men. It also is an opportunity for the Yemeni authorities to recognize the important role of women by abolishing all discriminatory laws and replacing them with others that provide girls and women legal protection from abuse as well as equality with men in family matters such as marriage, divorce and inheritance as well as in political participation.
Q: What does Amnesty International want to see happen in Yemen in 2012?

In 2012 the new government must urgently bring about the human rights change that protesters have been calling for. In particular:

  • by repealing the immunity law so as to bring to justice where there is sufficient admissible evidence anyone found responsible for such violations regardless of rank or affiliation;
  • by ceasing human rights violations, in particular by reigning in its security forces and ending unlawful killings of peaceful demonstrators and others;
  • by allowing an international, independent investigation into human rights violations; and 
  • by allowing access to Amnesty International and other independent human rights monitors into the country.
Amnesty International also holds the international community responsible for supporting accountability and justice in Yemen, and calls on Yemen’s partners to put pressure on the government to repeal the immunity law and to call for an international, independent and impartial investigation into current and past human rights violations.

Amnesty also wants to see with regard to future
arms supplies, the suspension of all types of weaponry, munitions and related equipment to the Yemeni police and security forces, which could be used for excessive or lethal force in policing pro-reform protests.
Arms supplying states should conduct a rigorous, comprehensive review of all international transfers and training support to Yemen’s military, security and police forces to ensure no arms transfers are authorized where there is a substantial risk that they will be used to commit or facilitate serious violations of international human rights law and international humanitarian law. Where necessary governments should halt the delivery of arms and revoke export licences.
Q. In what ways is the immunity law illegal?

The immunity law breaches Yemen’s obligations under international law to investigate and prosecute crimes under international law and human rights violations. Under international law, including the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Yemen is a state party, Yemen is obliged to investigate and prosecute anyone suspected of such crimes where there is sufficient admissible evidence.
In addition, as a state party to the Convention on the non-applicability of statutory limitations to war crimes and crimes against humanity, Yemen has recognized that if genocide, crimes against humanity or war crimes are committed, the provisions of the Convention (which provides that no statute of limitation may apply to these crimes) shall apply to representatives of the State authority and private individuals who, as principals or accomplices, participate in or who directly incite others to the commission of any of those crimes, or who conspire to commit them, irrespective of the degree of completion, and to representatives of the state authority who tolerate their commission.
Although it is commonly accepted that state officials are immune in certain circumstances from the jurisdiction of foreign states with respect to ordinary crimes under national law, such immunities do not apply – either in a foreign or national court – when the official is suspected of responsibility for crimes under international law – genocide, crimes against humanity, war crimes, torture, enforced disappearance and extrajudicial executions. This position has been confirmed over the course of six decades in numerous instruments. In addition, states are increasingly providing in national legislation that claims by officials to immunity from prosecution in their courts for crimes under international law are not recognized

Security Council: Russia must not block efforts to end atrocities in Syria


Russia has threatened to block a UN Security Council resolution on Syria for the second time

Russia must not block international efforts to tackle the ongoing violence and human rights violations in Syria, Amnesty International said today amid negotiations over a resolution on Syria at the UN Security Council.
Russian officials have threatened to veto the resolution if it comes to a vote.
Russia was one of several Security Council members to block a previous resolution on Syria on 4 October 2011. According to reports received by Amnesty International, more than 2,600 people have been killed in Syria since then.
“Russia’s threats to abort a binding UN Security Council resolution on Syria for the second time are utterly irresponsible. Russia bears a heavy responsibility for allowing the brutal crackdown on legitimate dissent in Syria to continue unchecked,” said José Luis Díaz, Amnesty International's representative to the UN in New York.
“Russia must work with other Security Council members to pass a strong and legally binding resolution that will help to end the bloodshed and human rights violations in Syria once and for all.” 
As the Syrian government’s largest overseas arms supplier, Russia has reportedly continued arms shipments into the country in recent weeks, even as Arab League observers reported back on ongoing human rights violations carried out by Syrian security forces.
Amnesty International has called for the Security Council resolution to refer the deteriorating situation in Syria to the Prosecutor of the International Criminal Court, impose an arms embargo on Syria and to freeze the foreign assets of President Bashar al-Assad and other senior figures.
The new draft resolution is based heavily on a resolution adopted by the Arab League on 22 January, in the aftermath of a report by the observer mission it sent to Syria in December 2011.
The Arab League text called for, among other things, the Syrian authorities and the opposition to begin serious political dialogue within two weeks on issues including the formation of a national unity government; restoring security; and reorganizing the police.
It also called for an independent commission of inquiry to be set up by the national unity government to investigate human rights violations against the Syrian people and ensure those responsible are brought to justice.
The Syrian authorities have rejected that proposal.
While the latest draft UN Security Council resolution is a step in the right direction, it fails to request an asset freeze, the referral of situation in Syria to the ICC or a comprehensive arms embargo.
Amnesty International has concluded that crimes against humanity are taking place in Syria – a finding also made by a UN Independent International Commission of Inquiry months ago. The draft resolution does not echo the UN Commission’s explicit call for independent and impartial investigations of all suspected perpetrators of such grave crimes.
“It is encouraging that the UNSC is finally poised to take action to address the Syrian crisis. But the draft falls short of what’s required,” said José Luis Díaz.
“After more than 10 months of a government campaign of killings, arbitrary detention, torture and enforced disappearances, clear mechanisms for accountability must be at the heart of the Security Council's efforts to end the crisis.”
“The Security Council must now refer the deteriorating situation in Syria to the Prosecutor of the International Criminal Court, freeze the overseas assets of President al-Assad and his senior associates, and impose an arms embargo.”
